Addictive Design Verdict

KGM—now 20 years old—shared that she began using YouTube at age six and Instagram at nine. The plaintiff described patterns of compulsive use, including days when she spent as many as 16 hours on Instagram. The central argument asserted that the platforms’ design choices—such as endless feeds and auto-playing recommendations—were crafted to hook young users and maximize advertising revenue. Supporters drew parallels to other industries that market addictive products to children.

The plaintiffs contended Meta and YouTube deliberately shaped their products to heighten engagement, borrowing techniques associated with gambling and, they argued, the aggressive, profit-driven tactics once seen in tobacco marketing. They claimed the purpose of these features was not merely to entertain but to trap impressionable minds in a continuous loop of scrolling and exposure to content.

Meta’s internal communications were a key piece of the case. Jurors heard that one study, called “Project Myst,” allegedly linked adverse experiences in childhood to a greater likelihood of developing an addiction to Instagram, while executives were described as noting that parents were often powerless to intervene. Lanier, KGM’s lead attorney, pressed the comparison to other industries known for harm. He asserted that the company’s own internal knowledge pointed toward foreseeable harm, and that the failure to act promptly constituted a breach of duty.

Meta faced direct questions about safety measures added in recent years. While Zuckerberg testified that the company has shifted toward safer design choices, he acknowledged that more could have been done sooner. He defended the company against the claim that its aim was to maximize time spent online, and he framed safety improvements as ongoing, not retroactive, efforts.

YouTube’s side argued that the case hinged on the way content is delivered rather than the content itself. The defense leaned on arguments tied to Section 230 protections, contending that platforms should not be held liable for user-generated content. The judge, however, instructed jurors that the engineering and presentation of the platform—how content is delivered and surfaced—could be treated separately from the user-posted content itself, curtailing some of the typical Section 230 defenses.

This was one of the first major jury trials against Big Tech on the issue of design-induced harm. In a parallel matter in New Mexico, a different jury found Meta’s practices concerning child safety and exploitation practices to be false or misleading, resulting in a substantial penalty. The outcomes in these coupled cases illustrate a growing willingness of juries to weigh design choices as a cause of damage, beyond the content at issue.

The case also spurred discussion about class-action potential and the possibility of parallel actions across jurisdictions. Lawyers and scholars noted that the verdict could inform both individual claims and class actions, potentially triggering a broader reckoning for platforms globally.
